The following are terms
of a legal agreement between you (“STUDENT”) and Get Defensive Video (“GD”). By accessing, using, and/or browsing
this site, and/or viewing the Get Defensive Video, you acknowledge that you have
read, understood, and agree to be bound by the terms of this agreement.
Use of the GD web site and video:
Falsification of documents submitted to the
court is a crime and is punishable by law.
By registering for the GD
course and receiving a Certificate of Completion, STUDENT states that
he/she studied all of the material in the GD course, completed all of
the quizzes at the end of the chapters, and completed and passed the
final examination at the end of the course.
If GD discovers that
STUDENT has willfully misrepresented himself/herself, has cheated, or
has attempted to circumvent the security validation mechanisms, STUDENT
will be stopped from taking the course with no refund of the
registration fees. STUDENT also may be prosecuted for perjury and other
criminal acts.
Charges and Terms of Payment:
By registering for the course, a
fee in the amount of $35.00 will be charged to STUDENT. This includes the cost of shipping the video
to STUDENT by US Mail,
access to all educational materials in the course as well as all
quizzes and three attempts at passing the final exam. It also includes
the price of the Certificate of Completion upon passing the course and
the mailing of the certificate via US Mail. However, there will be
additional charges for the expedited shipping of the video and/or certificate, which
will vary based on the type of delivery method selected. All fees must
be paid in full before STUDENT begins the course. STUDENT may pay by
credit card, check, or money order.
Course Schedule:
This course is comprised of 5 hours of video, as well as a final
exam, to be
completed in 6 hours, at a minimum. Sharon Naim
is the Instructor for
this course (#CP021).
GD will be available to STUDENT 24 hours a day, 7
days a week. This availability may be affected by circumstances such
as, but not limited to: system, site, or connectivity failure over
which GD has no control.
Grading and Progress Policy:
STUDENT agrees that he/she may
not be certified or given credit for the course unless STUDENT scores
70% or higher on the final exam.
Alternative testing techniques for
students with reading, hearing, or learning handicaps and policies for
re-testing students who score less than 70% will be a) a review of
material; b) translation, if necessary and possible; and c) re-testing,
verbally if necessary.
Timers: STUDENT is required to view the
entire course, as well as spend the required amount of time on break periods.
Cancellation and Refund Policy:
A full refund will be made to
STUDENT, prior to attempting the final exam, if he/she cancels the
enrollment contract within 3 business days of registering. This does
not include Saturdays, Sundays, or Holidays. STUDENT also must return all course
materials before any refund will be issued.
If STUDENT has not
successfully completed the course within 180 days, his/her registration
will be terminated without notice and he/she will not be eligible for a
refund. All registration fees paid are due and refundable when the
course of instruction is discontinued by GD, preventing STUDENT from
completing the course, or the enrollment of STUDENT was procured as a
result of any misrepresentation in the advertising and promotional
materials of GD, or any misrepresentation made by the owner or employee
of GD. Any refund will be made within 30 days of the effective date of
termination.
Completion and Certificate Policy:
STUDENT understands that
he/she must complete all sections of the course material and pass the
final exam with a score of 70% or higher in order to receive his/her
Certificate of Completion. GD is prohibited from issuing a uniform
certificate of course completion if STUDENT has not met all of the
requirements for course completion, and STUDENT should not accept a
uniform certificate of course completion under such circumstances.
Video and Computer Requirements:
STUDENT may view the
course in DVD format.
In order to access the online student testing center,
GD prescribes minimum
hardware and software requirements for completing the course. Minimum
browser requirements include the use of Microsoft Internet Explorer
(MSIE) 6.0 or greater, Netscape version 4.8 or greater, or any other
browsers that provide equal or greater functionality.
The online student testing center requires the use of a pointing device such as a mouse.
By accepting this
contract, STUDENT acknowledges and understands these computer
requirements. If STUDENT is unable
to access the online student testing center, he/she may complete the personal validation
questions, quizzes, and final exam through GD’s automated, toll-free telephonic
testing program. To access the telephonic
testing program, STUDENT must have a touch-tone telephone.
If STUDENT is unable to access the telephonic testing program, he/she may
take the personal validation questions, quizzes, and final exam verbally with a
GD customer service representative over the telephone.
Third-Party Data: STUDENT understands that for student
validation purposes, GD will access public databases from the Texas
Department of Transportation and the Texas Department of Public Safety
in order to extract driver’s license and vehicle registration
information. STUDENT authorizes GD to access this information under the
condition that it be used exclusively for the purpose of student
validation.
Student Validation Requirements: STUDENT understands that
he/she must respond correctly to personal validation questions taken
from information retrieved from public databases throughout the course
in order to verify his/her identity. If no information pertaining to
STUDENT can be retrieved from the databases, STUDENT must submit to GD
a notarized Statement of Assurance. If a Statement of Assurance is
required, STUDENT'S course will be deemed completed only upon receipt
by GD of STUDENT"S notarized Statement of Assurance.
